1. Introduction

Welcome to GreenGlamTech (“GGT”, “we”, “us”, or “our”). These Terms of Use and Privacy Policy (collectively, the “Agreement”) govern your access to and use of our mobile application, website, and any related services we provide (collectively, the “Services”).
By accessing, downloading, or using the Services, you agree to be bound by this Agreement. If you do not agree with these terms, do not use the Services.
This Agreement is a legal contract between you (“you,” “your,” or “User”) and GGT. It describes your rights and responsibilities, our rights and responsibilities, and other important terms. Please read it carefully.

For the purposes of this Agreement:
 

• “Content” refers to all text, images, videos, graphics, AI-generated outfits, and other materials provided through the Services.

• “User Content” means any content you upload, post, or otherwise provide to the Services, including photos of your wardrobe or outfits.

• “Personal Information” refers to data that identifies or can reasonably be linked to an individual user, as defined under applicable data protection laws.

2. Eligibility & User Accounts

2.1 Eligibility Requirements
To use the Services, you must be at least 13 years old or the minimum age required by law in your jurisdiction to form a binding agreement. By using the Services, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into this Agreement.
If you are under the age of majority in your jurisdiction (typically 18 years old), you may only use the Services with the consent of a parent or legal guardian. We do not knowingly collect Personal Information from children under 13. If we become aware that we have collected such information, we will delete it promptly.

2.2 Account Registration
To access certain features of the Services—such as your virtual closet, AI outfit planner, or purchase history—you may need to create a user account. When registering, you agree to provide accurate, current, and complete information and to update your information as needed.

2.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials (username, password, or other authentication methods) and for any activities under your account. You agree not to share your credentials or allow anyone else to access your account.

If you believe your account has been compromised, you must notify us immediately at greenglamtech1@gmail.com.

2.4 Account Termination or Suspension
We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated any part of this Agreement, engaged in fraudulent or abusive activity, or compromised the security or integrity of the Services.
 
3. User Conduct & Acceptable Use

3.1 Permitted Use
You agree to use the Services only for lawful purposes and in accordance with this Agreement. You may use the Services to:
 

• Manage your wardrobe and virtual closet.

• Create AI-generated outfits and receive personalized recommendations.

• Interact with features designed for planning, organizing, or sharing outfits.
   

3.2 Prohibited Activities
You agree not to:
 

• Upload, post, or share content that is illegal, harmful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable.

• Infringe on the intellectual property or privacy rights of others.

• Attempt to gain unauthorized access to any part of the Services, user accounts, or systems connected to the Services.

• Use automated means such as bots, crawlers, or scrapers to access or collect data.

• Reverse engineer, decompile, disassemble, or attempt to discover the source code or algorithms of the Services.

• Introduce viruses, malware, or harmful code that could damage or interfere with the Services.

• Impersonate any person or entity, including GGT staff, or misrepresent your affiliation with anyone.
   

3.3 Enforcement and Consequences
We reserve the right—but not the obligation—to monitor use of the Services to ensure compliance. If we determine, at our sole discretion, that you have violated these rules, we may:

• Remove or disable access to any User Content that violates this Agreement.

• Suspend or terminate your account.

• Report your conduct to law enforcement if required.

4. Intellectual Property

4.1 Ownership of GGT Content
All intellectual property rights in the Services and their original content—including text, graphics, images, logos, software, AI algorithms, and virtual try-on technology—are the exclusive property of GreenGlamTech or its licensors. These materials are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Services except as expressly permitted in this Agreement.

4.2 User Content
You retain ownership of any User Content you upload or submit. However, by providing User Content, you grant GGT a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works, distribute, and display such User Content for operating, improving, marketing, and providing the Services. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe or violate any third-party rights.

4.3 Third-Party Content & Links
The Services may include links to third-party websites or content. GGT is not responsible for the content, privacy practices, or policies of third-party websites or services. Access them at your own risk.

4.4 Trademarks
The GreenGlamTech name, logo, and related marks are trademarks or registered trademarks of GGT. You may not use these marks without our prior written consent except as allowed under applicable law.
 
5. AI & Virtual Try-On Disclaimer

5.1 AI-Generated Recommendations
Our Services use artificial intelligence to suggest outfit combinations, recommend clothing items, and assist with wardrobe planning, based on the information you provide.

5.2 Accuracy & Limitations
While we strive for accurate AI-generated suggestions, these outputs are for informational and entertainment purposes only. We do not guarantee that suggested outfits will fit perfectly, reflect true colors, or meet style expectations. Factors such as display variations, inaccurate measurements, and sizing differences can affect accuracy.

5.3 User Responsibility
You are responsible for any decisions you make based on AI-generated suggestions. GGT is not liable for dissatisfaction, loss, or damage resulting from reliance on these recommendations.

5.4 No Professional Advice
The Services do not provide professional fashion, styling, or shopping advice. AI-generated content should not replace professional guidance if you require personalized fashion consultation.
 
6. Purchases & Subscriptions

6.1 Pricing and Payment
Certain Services, including premium features, may require payment. Prices will be clearly displayed. By purchasing or subscribing, you agree to pay all applicable fees and authorize GGT or its payment processors to charge your payment method.

6.2 Subscription Renewals
Subscriptions will automatically renew at the end of each billing period unless you cancel before the renewal date.

6.3 Cancellation
You can cancel your subscription at any time through your account settings or by contacting us at greenglamtech1@gmail.com. Cancellations take effect at the end of your current billing period.

6.4 Refunds
All purchases and subscriptions are final and non-refundable, except as required by law or as otherwise stated. To request a refund under applicable law, contact us at greenglamtech1@gmail.com.

6.5 Dispute Resolution for Purchases
If you have concerns about charges or payments, you agree to contact us first at greenglamtech1@gmail.com to attempt to resolve the issue before initiating a dispute with your payment provider.
 
7. Privacy Policy

We collect information to provide and improve our Services, including:

• Personal Information: name, email, wardrobe photos, personal photo.

• Usage Data: features you use, outfits created, in-app actions.

• Device & Technical Data: IP address, device info, operating system, cookies.

• Third-Party Data: information from partners or integrations, e.g., social media platforms.
   

7.2 How We Use Your Information
We use your information to:

• Operate and improve the Services.

• Personalize your experience, including AI recommendations.

• Communicate with you about your account, updates, and offers.

• Analyze usage to develop new features.

• Enforce our terms and comply with legal obligations.
   

7.3 Sharing Your Information
We may share your information:

• With service providers (e.g., hosting, payment processors).

• With partners or affiliates when needed to deliver the Services.

• If required by law or legal process.

8. Disclaimers & Limitation of Liability

8.1 No Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, GGT disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.

8.2 Limitation of Liability
To the maximum extent permitted by law, GGT and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or goodwill, arising from:

• Your use or inability to use the Services.

• Conduct or content of other users or third parties.

• Content obtained through the Services.

• Unauthorized access, use, or alteration of your content.
   

GGT’s total liability for any claim will not exceed the amount you paid to GGT in the 12 months before the claim arose.

8.3 Jurisdictional Limitations
Some jurisdictions do not allow certain disclaimers or limitations. In those cases, the disclaimers and limitations apply to the fullest extent permitted.
 
9. Indemnification
You agree to defend, indemnify, and hold harmless GGT, its affiliates, officers, employees, agents, licensors, and partners from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:

• Your use of the Services.

• Your violation of this Agreement.

• Your infringement of third-party rights.

• Your User Content or conduct on the Services.
   

This obligation survives termination of this Agreement.
 
10. Changes to the Terms & Privacy Policy

10.1 Right to Update
We may modify this Agreement at any time to reflect changes to our practices, laws, or Services.

10.2 Notice of Changes
We will notify you of material changes by:

• Posting the updated Agreement on our website or app.

• Sending email or in-app notifications to registered users.
   

10.3 Effective Date of Changes
Updated terms take effect immediately unless otherwise stated. Continued use after changes constitutes acceptance. If you disagree with updates, stop using the Services and cancel your account.
 
11. Governing Law & Dispute Resolution

11.1 Governing Law
This Agreement and any disputes will be governed by the laws of the Province of Manitoba, Canada, without regard to conflict of law principles.

11.2 Dispute Resolution
You agree to first attempt to resolve disputes by contacting us at greenglamtech1@gmail.com.

11.3 Arbitration Agreement
If disputes cannot be resolved informally, they will be settled by binding arbitration administered by the ADR Institute of Canada under its then-current rules. Arbitration will take place in Winnipeg, Manitoba or virtually, in English.

11.4 Exceptions to Arbitration
Either party may bring qualifying claims in small claims court or seek injunctive relief in court to protect intellectual property rights.

11.5 Waiver of Class Actions
Disputes must be resolved individually, not as part of a class, consolidated, or representative action.

11.6 Limitation Period
Claims must be filed within one (1) year of arising, or they are permanently barred.
